Progress in AI’s capacity to understand and replicate human creativity—especially emotional expression—may be necessary for the emergence of a truly new genre. As of May 2026, AI models excel at producing novel sounds or stylistic combinations but lack the cognitive framework to define and contextualize a new genre in the way humans do. The jury found that while AI may assemble fresh combinations of existing sounds, those creations still wear recognizable genre costumes rather than inventing an entirely unheard-of musical tongue of its own; one juror hoped the verdict might be upgraded someday if the next algorithmic offspring learns to speak in a tone no human ear has ever known. The bench therefore returns a split, cautious “almost” and declares the case open—but not yet closed. Ruling: AI can remix the past, yet the future’s music remains humming in the jury’s imagination.
